Jordan practices in the areas of commercial litigation, securities litigation, employment litigation and constitutional law.

Jordan's litigation practice focuses on complex commercial disputes. He has widespread experience in corporate matters, including shareholder and partnership disputes, oppression claims, derivative actions and plans of arrangement. This work is complemented by a growing securities litigation practice, both in the civil liability and regulatory contexts, acting for financial institutions, companies, and directors and officers. More generally, Jordan routinely litigates claims related to contracts, fraud, professional negligence, product and construction liability and employment law.

Jordan also provides constitutional advice and representation to government and businesses on matters such as banking, energy, the environment, pipelines, securities and telecommunications. Significantly, Jordan served as co-counsel to the Attorney General of Alberta in the landmark Securities Act References heard by the Alberta Court of Appeal, Québec Court of Appeal and Supreme Court of Canada which upheld provincial jurisdiction over trading in securities.

Jordan has appeared before all levels of Court, including the Courts of several provinces and the Supreme Court of Canada. He is also experienced in arbitrations, private and court-supervised mediations, and negotiations

  • Defending a senior officer and director in related securities class actions and regulatory proceedings
  • Representing a lending syndicate in a $30 million auditors' negligence claim
  • Acted for an energy company regarding a right of first refusal over a $100 million real estate asset
  • Obtained judicial approval for, and exercised dissent rights in relation to, several plans of arrangement
  • Associate counsel in a trial holding defendant contractors liable for Calgary's largest ever fire
  • Acted for an energy company in a novel case of tripartite set-off in the CCAA context
  • Advised an energy company with respect to a significant crude oil pricing dispute
  • Obtained various orders interpreting, rectifying and directing the specific performance of contracts
  • Secured and resisted prejudgment relief, including attachment orders and injunctions, in several actions
