On July 11, 2013, Justice C.M. Jones rendered his judgment in Perehudoff v. Christiano, 2013 ABQB 390 in favour of a Rose LLP client. The encompassing judgment addressed the scope of the implied undertaking rule in related party proceedings, the limitation period applicable to constructive trust and deemed trust claims arising from the demise of a relationship, and the quality of evidence required to support and resist an application for security for costs.
