Rose LLP Successfully Strikes Contribution Claims in Oil Sands Dispute

Rose LLP is counsel to Fluor Canada Ltd., a leading global EPC company, in an $87 million oil sands project dispute. Rose LLP lawyers applied on behalf of Fluor to strike six third party claims advanced against Fluor by manufacturers and suppliers to the project. The application was before the Alberta Court of Appeal, where Fluor was represented by Lowell Westersund, Q.C., Phil Scheibel and Josh Fraese. The Court of Appeal struck all allegations that Fluor breached duties of care to the project owner, in a decision which clarifies the law relating to contribution claims, reported as Arcelormittal Tubular Products Roman S.A. v. Fluor Canada Ltd.,  2013 ABCA 279.
